NEW PRODUCT & SERVICE IP PROTECTION SERVICES
01
IP SEARCHING
Before obtaining IP protection, it’s crucial to understand the current market, opportunities, and risks. Any time you have a new offering, we’ll start with an IP search. Also known as a clearance or freedom to operate (FTO) search or patentability search, this process uncovers if:
-
A trademark is registerable (i.e., are there already confusingly similar marks out there?)
-
A technology is patentable
-
There is room in a crowded market for a new product
02
IP STRATEGY
Following the search, Kim will establish a strategy based on your company’s products/services, the competitive landscape, where you sell/distribute them, and your goals. She will garner clearly defined protections while ensuring flexibility for the future direction of your business by:
-
Recommending where and what to file for the strongest protection in the U.S. and worldwide
-
Securing different and overlapping types of protection when necessary (i.e., patent, trademark, copyright)
-
Offering a varied scope of protection when applicable (e.g., a name and logo, a method or system, etc.)
03
IP PORTFOLIO MANAGEMENT
Kim will remain your IP counsel long after the initial research and strategy are complete. She will manage your or your client’s entire IP portfolio with ongoing services, including:
-
IP Searching: You’ll need regular IP searches whenever you add new products or services, to find out if your planned activity infringes on another entity’s IP, and to find out if someone else infringes on your IP.
-
Filing: Kim will file any necessary patents, trademarks, and copyrights for your new products or services.
-
Prosecution: Kim will advocate on your behalf (or that of your client, in the case of foreign associates) before the relevant government office between filing and patent granting or copyright/trademark registration.
-
Watch Services: Also known as trademark monitoring services, this involves looking for filings by others—both in the U.S. and internationally—that might interfere with your or your client’s IP (e.g., logos and names that are too close).
-
Maintenance: With Kim as your IP attorney, your issued patents and registered trademarks will be maintained worry-free! She will handle fee payments and filings as they are due at certain intervals to keep the IP from becoming abandoned.
