What is...a trademark or a service mark?


Federal Registration of a trademark or service mark requires use across state lines. Common law trademark rights arise by using a mark in commerce and generally only extend to where that use has occurred. In contrast, if you receive a federal registration you have protection in all 50 states even if you have yet to use the mark in commerce in all of those states. Trademark and service mark rights are territorial. You may also wish to protect your brand around the world.
